    What’s the Divorce Process

    The divorce process refers to the steps taken in terminating a marriage. There are many myths and misconceptions revolving around divorce. For starters, the majority of people have come to see divorce as a long and expensive process. 

    This myth can be broken by Divorce lawyers who will assist in winning the case.While there are several ways to go about a divorce, most cases in the United States fall under two classes. They are either filed as a no-fault divorce or a fault-based divorce. 

    A no-fault divorce is not based on any particular reason. That means you are filing for divorce for the sake of leaving your spouse. In contrast, a fault-based divorce is on grounds such as abandonment, adultery, or abuse. 

    To start the divorce process, one spouse must file a petition for divorce with the court. This document will state the grounds on which the divorce is being sought and any other relevant information. 

    Once the spouse has filed for the divorce, they must serve the other spouse the divorce papers. The spouse then has a certain amount of time to respond to the petition.

    The next step (discovery process) comes after filing and serving the divorce papers. The discovery process involves spouses gathering information about each other that they will use in court. This information includes their spouse’s assets, income, and debt situation.

    Upon completion of the discovery process, the next step is filing for a divorce decree. A divorce decree is a legal document that terminates the marriage. The document includes key information on asset division, child custody, spousal support, etc. 

    Once these decisions are set in stone, the divorce takes full effect, and both parties will be free to move on with their lives.

    Still, a few things can happen even after finalizing the divorce. For instance, a spouse might decide to contest the divorce if they do not find the court’s decision satisfactory.

    Likewise, a spouse may fail to follow the divorce decree. This could mean failure to pay spousal or child support as instructed by the court. It could also mean failure to adhere to the terms of custody and visitation.

    On such grounds, the other spouse can take legal action to enforce the divorce decree. This could include hiring child support lawyers to enforce the child support decree.
